Art. 2 Purchase of tickets for exhibitions, events and guided tours

(1) All information given by the BKF with respect to offered exhibitions, events and guided tours on websites, in brochures, on posters, in apps and within the framework of any other kind of promotional presentations shall be subject to change and non-binding.

(2) A contract on the purchase of tickets via the online shop of the BKF at https://shop.buceriuskunstforum.de shall be concluded as follows:

The online tickets shall be selected by the customer in the online shop and put into the electronic shopping cart. Prior to clicking the button “Proceed to Checkout”, attention is drawn to the applicable Terms and Conditions and the privacy statement, the content and acknowledgement of which must be confirmed. Then, the customer is directed to sign-in or to have himself or herself registered (either as visitor or by opening a customer account) in the online shop. After having entered all login or registration data required for completing the purchase transaction, the customer shall be asked to confirm or, as the case may be, to edit and confirm the ticket data and input data which are again displayed for this purpose. Moreover, the customer has to select one of the offered payment options. When, finally, the customer clicks the “Buy Now” button, he or she is placing a binding offer to purchase the selected online tickets under the indicated and chosen conditions. The confirmation of the ticket purchase given in this case by the system together with a request for payment shall constitute the acceptance of the offer, with the result that the purchase of the selected tickets has been completed with binding effect under the terms agreed upon. After payment, the customer shall receive an order confirmation from the BKF by e-mail in a saveable and printable format that again indicates all purchased online tickets and repeats all contract components. If the offer is not accepted, it shall expire without contract conclusion.

(3) For concluding and implementing the contract via the online shop, the customer shall be in need of an internet access, a valid e-mail address and, in addition, a possibility to print the online ticket or, alternatively, a suitable mobile device (for instance a smartphone or tablet PC) in order to be able to present and scan the barcodes/QR codes shown on the online tickets at the entrance.

(4) In the business premises of the BKF, particularly at the cash desks available for this purpose, a contract on the purchase of tickets shall be concluded as follows:

At the cash desk of the BKF, the customer shall inform the person in charge about the tickets he or she wants to purchase. Thereupon, the person in charge shall provide information on the purchase price to be paid in return. The customer may pay the purchase price in cash or by electronic means of payment (EC card or major credit card; see Art. 6). By his or her payment, the customer shall be  deemed to have placed a binding offer for concluding the purchase contract relating to the tickets; such offer shall be subject to the conditions agreed upon in advance with the person in charge, all other evident conditions (e.g. the announced duration of the exhibition) and, apart from that, the Terms and Conditions either made available at all cash desks or referred to otherwise. The offer shall be deemed to have been accepted upon receipt of the payment by the BKF.

Art. 3 Receipt of tickets, kinds of tickets

(1) When purchasing a ticket via the online shop, the customer shall be provided with the online tickets in form of an attachment to the e-mail, including barcode/QR code, sent by the BKF to the e-mail address to be indicated by the customer together with the contract confirmation; such online tickets may then be printed out or displayed on a mobile device.

(2) When purchasing a ticket in the business premises of the BKF, the customer shall receive the acquired tickets in paper form directly upon contract conclusion.

(3) Exhibition tickets shall entitle the customer to visit a specific exhibition for the period of its duration and within the visiting hours of the BKF. With respect to the additional terms applicable to the admission at the entrance, reference is made to Art. 7. If the customer wants to avoid waiting times resulting from particularly high numbers of visitors at a time, he or she may purchase special time slot tickets according to paragraph 4 below.

Tickets for events and guided tours shall exclusively be valid for the respective events or guided tours at the fixed times indicated in each case.

Every ticket may be used for a non-recurring visit of one person only; after having been used for one visit or upon expiry of the time or period scheduled for the respective event or guided tour, it shall cease to be valid.

(4) Time slot tickets shall authorise the customer to visit the respective event within the exact time frame specified on the ticket (as a gesture of goodwill, plus 15 minutes). During this period, the customer shall unconditionally and regardless of the rush of visitors and the capacities in the exhibition rooms be entitled to visit the exhibition. The BKF shall ensure that customers holding a time slot ticket are offered sufficient capacities in the exhibition premises for being able to visit the exhibition in an orderly manner. A right to enter the exhibition rooms outside the specified time frame shall not exist. The decision on the length of stay in the Bucerius Kunst Forum after having been admitted to the premises, however, shall be up to the customer.

(5) The customer shall be responsible for keeping his or her ticket in safe custody and protect it against any access by third parties. A resale of tickets shall not be permitted.

Art. 4 Discounts and free entry

The visit of an exhibition, event or guided tour at an agreed reduced price or free of charge (e.g. due to a student status, for socially disadvantaged people and club members) shall be possible only if the reason for the reduction or freedom from costs still exists on the day of the visit and can be proven at the time of entry by submitting written documents to the check-in staff. In the event of failure to provide evidence, entry to the premises shall be allowed against payment of the difference vis-à-vis the total ticket price at the cash desk only. A combination of several discounts shall be excluded.

Art. 5 Merchandise items

(1) The BKF offers possible merchandise items (e.g. catalogues, calendars, textiles, small gift articles and the like) in its business premises and via its online shop.

(2) The provisions in Art. 2 relating to the non-binding character of information and the manner of contract conclusion shall apply mutatis mutandis, whereas the printing of tickets during the purchase of merchandise items shall not apply.

(3) Orders for merchandise items via the online shop of the BKF shall be subject to the delivery conditions and costs agreed upon in each case during the ordering procedure and the delivery costs shall be borne by the customer. Until payment in full, the delivered goods shall remain the property of the BKF.

Art. 6 Prices, payment, vouchers

(1) The prices agreed upon during contract conclusion shall be applicable. Unless otherwise agreed upon, prices shall be inclusive of VAT, if any. Prices indicated prior to contract conclusion shall be subject to change.

(2) In case of purchases via the online shop, the indicated purchase price shall become due for payment at the time when the contract comes into force.

Payments in return for purchases via the online shop can be made by means of a major EC or credit card (Visa MasterCard), via PayPal or by instant bank transfer. If an immediate payment system is chosen (PayPal or instant bank transfer), the customer shall be directed to the respective internet page of the provider of such immediate payment system. There, the customer has to enter his or her personal data for the checkout process.

(3) If a ticket is bought in the business premises of the BKF, the purchase price shall become due for payment in the course of contract conclusion. Payment can be made via a major EC or credit card (Visa, MasterCard) or in cash.

(4) If, in the event of a use of a credit card, a payment is to be redebited, the customer shall be obliged to bear any costs arising in this context, particularly any costs charged by third parties such as, for instance, the bankers involved. Any further demands on the part of the BKF due to delay or non-performance by the customer shall remain unaffected. For avoiding the costs occurring for redebiting purposes, the customer is in case of a legally effective contract rescission, a return delivery, a complaint or a revocation kindly asked to refrain from withdrawing the direct debiting process already initiated and to contact the BKF with respect to the return of payments. If the amount of payment is returned, the customer shall not be entitled to request entry on the basis of the respective ticket.

(5) Instead of paying according to the aforementioned provisions, tickets and merchandise items may also be paid by means of valid vouchers issued by the BKF. Vouchers for several EUR amounts can be purchased against immediate payment at the cash desk in the premises of the BKF or in the online shop. The vouchers shall be accepted as means of payment at the cash desk of the BKF and in the online-shop for all purchases of tickets or merchandise items with the BKF; the voucher shall be redeemed within 18 months, a return or exchange for cash shall be excluded; using the voucher for already purchased orders and the combination of various vouchers shall be excluded. Upon submission of a voucher in a purchase transaction, payment shall be deemed to have been made in the amount stated on the voucher. Vouchers shall not be personalised and may be used by the person presenting the voucher. Vouchers purchased from the BKF shall be accepted by the separately operated Book Shop in the premises of the BKF only if this is explicitly indicated on the voucher or has been agreed upon otherwise.

Art. 7 Admission to an exhibition

(1) When the customer wants to visit the booked exhibition, he or she has to go to the exhibition entrance area with the BKF and there to the entrance for general exhibition visitors or, as the case may be, to the entrance for visitors holding a time slot ticket.

(2) The customer shall be allowed to enter the premises only if he or she presents the purchased ticket at the entrance and if the information on the ticket give evidence that the ticket price has been paid (and not been refunded) and that the respective ticket has not been used before. If the ticket was bought via the online shop, the customer may show the online ticket sent to him or her by e-mail by presenting it at the entrance as printed and legible hard copy or via the display of a suitable mobile device.

(3) Admission may be denied if any items carried by the customer or if the customer’s state or behaviour give/s reason to believe that the house rules according to Art. 11 of these Terms and Conditions could be violated or that any objects or furnishings could be damaged or destroyed or that other visitors could be disturbed in an unacceptable manner. Admission may also be denied if an orderly and safe visit is not possible as a result of the great number of newly arrived visitors or the multitude of customers privileged due to their time slot tickets. Unless there is need to take reasonable regulatory measures, customers with time slot tickets, however, may be prevented from entering the premises only if they request admittance outside the access times specified on the time slot ticket.

(4) Visitors shall be granted access during opening hours, always provided that they arrive no later than 20 minutes before closing. With respect to opening hours and admission times, reference is made to the internet appearance of the BKF and the notice in the entrance area of the exhibition building.

§Art. 8 Admission to events and guided tours

(1) If the customer wants to visit the event or guided tour booked by him or her, he or she has to come to the entrance or meeting point of the respective event venue or guided tour location.

(2) The provisions on admittance in Art. 6 (2) and Art. 6 (3) sentence 1 shall apply mutatis mutandis.

(3) Entry shall exclusively be granted at the time of admission, as scheduled for the event or guided tour and specified on the ticket in each case.

Art. 9 Liability and damages; reimbursement due to an excessive number of visitors

(1) The liability of the BKF for damages shall be limited to cases caused by intent or gross negligence. This shall not apply to infringements of substantial contractual duties and to injuries to life, body or health. In case of a violation of substantial contractual duties due to ordinary negligence, the obligation to compensate shall be restricted to the foreseeable damage typical for the contract. A substantial contractual duty is defined as an obligation the proper fulfilment of which constitutes a condition sine qua non and the fulfilment of which may be regularly relied on and is actually relied on by the customer.

(2) The restrictions provided for in paragraph 1 above shall also apply to the favour of the legal representatives of the BKF and the persons employed by the BKF in the performance of its duties if claims are directly asserted towards them.

(3) The liability restrictions set forth in paragraph 1 shall not be applicable to the extent that the BKF has fraudulently concealed a material defect or has given a guarantee for the quality of an object or service. This shall likewise apply if the BKF and the customer have concluded an agreement on the quality of an object or service. The provisions of the product liability act shall remain unaffected.

(4) Customers’ liabilities shall be subject to statutory provisions. In case of intentional or negligent infringements of the house rules, the customer shall be liable for the resulting damage.

(5) If a customer holding a general ticket for an exhibition is able to show that, for reasons the BKF can be made liable for, he or she could not enter the exhibition premises on at least 2 days even after waiting periods of not less than 60 minutes in each case, the BKF shall upon the customer’s request take the tickets back and refund the price. Incidents lying within the sphere of responsibility of the BKF shall particularly include an excessive rush of visitors and all extraordinary closures of the exhibition insofar as the BKF can be made liable therefor.

Art. 10 Privacy

(1) The customer is kindly asked to note that the BKF collects, processes, uses and transfers personal data to third parties to the legally permissible extent either itself or via service providers in compliance with applicable legal provisions. Data collected and used shall particularly include all data necessary for the contractual relationship, for the proper provision of services and for billing purposes as well as all data admissible and required according to legal regulations. For details, reference is made to the Privacy Statement of the BKF accessible prior to making a contract offer and generally available on the BKF websites. The BKF shall properly protect such data and keep them secret towards third parties.

(2) In the event that you communicate with the BKF in electronic format, particularly via e-mail, such communication shall, in the absence of contrary information and until your revocation, be regarded as your consent to communicate this way. Please note that a communication via e-mail does not constitute a secure means of communication and that e-mails may theoretically be intercepted, altered and read by others.

Art. 11 Right of revocation

(1) In the event of a purchase of tickets for events and guided tours and of time slot tickets, a right of revocation on the part of the customer shall be excluded; to this extent, reference is made to the provisions set forth in Section 312g (2) no. 9 BGB [German Civil Code]. Likewise, a right of revocation shall not exist with respect to a purchase of tickets, vouchers or merchandise items in the business premises of the BKF.

(2) Orders for tickets, other than tickets for events, guided tours and other than time slot tickets (general exhibition tickets), made via the online shop shop of the BKF may be withdraw by the customer pursuant to the following conditions:
